Due to the changes, the project now returns to the Senate. The draft was prepared by a group of judges, court ministers and lawyers specializing in private law, under the leadership of Minister Dias Toffoli, president of the Federal Supreme Court.
According to Otavio Rodrigues, lawyer and professor of Civil Law at USP, "the approval of PL 1179 was a victory for society and an example of successful cooperation B2B Lead between magistrates, parliamentarians, universities and lawyers". For Rodrigues, who coordinated with minister Antonio Carlos Ferreira (STJ) the group of jurists responsible for the draft, "the text also reflects the contribution of jurists Arruda Alvim, Paula Forgioni, Fernando Campos Scaff, Rodrigo Xavier Leonardo, Rafael Peteffi da Silva, Francisco Satiro, Marcelo von Adamek, Roberta Rangel and Gabriel Nogueira Dias, in addition to several contributions received from institutes and associations".
Another factor that proved decisive for rapid processing, according to Rodrigues, is the quality of the parliamentarians involved in the project, such as Antonio Anastasia, Simone Tebet and Enrico Misasi, with solid legal training.
The proposal was approved in the form of a substitute for deputy Enrico Misasi (PV-SP), who removed some provisions from the text, such as the one that provided for a 15% reduction in commissions charged by transport apps from their drivers, transferring the amount to them . The measure would affect companies like Uber and 99.
Regarding rented properties, for example, the project suspends, until October 30 of this year, the granting of injunctions for the eviction of tenants due to late rent, end of the agreed vacancy period, dismissal of the tenant under a contract linked to employment or permanence of subtenant in the property.
The suspension covers urban properties (commercial and residential) and affects all actions filed from March 20th, the date on which the legislative decree that recognized the state of calamity in the country was published.
Until October 30th, the deadlines for acquiring movable or real estate property through adverse possession are also suspended.
Company assemblies
Misasi also removed from the text restriction rules for holding face-to-face meetings and assemblies by business companies, associations and foundations until October 30th.
